New York DUI/DWI Attorneys Protect Driver’s Rights

Helping clients fight drunk driving charges in Staten Island, the Bronx and throughout the tri-state area

New York is one of the toughest states on drunk driving. Many DUI-related charges carry mandatory sentences upon conviction, so it is imperative that you hire a skilled criminal defense attorney who can help you keep your license and stay out of jail. The lawyers with Gregg & Associates P.C. in Staten Island have represented clients throughout the tri-state area on DUI charges since 1998. You can rely on us to protect your interests at every stage, from arraignment through any trial and sentencing.

Challenging DWI evidence in court

To provide a comprehensive defense, our DUI attorneys will seek the answers to these and other questions:

  • Did the officer have probable cause to pull you over?
  • Did the officer follow required legal procedures throughout the stop and arrest?
  • Was the field sobriety test properly executed and accurate?
  • Was the breath test properly executed and accurate?
  • Did your blood sample follow the proper chain of custody?
  • Did you refuse to take a breath or blood test?
  • Was your blood alcohol content (BAC) higher at the time of your test than it was while you were driving?

We may be able to challenge your arrest and the charges filed based on our investigation, especially if law enforcement failed to properly perform any of their duties.

Drunk driving penalties in New York

Being stopped for driving with alcohol or drugs in your system can result in serious consequences. Losing your license and going to jail can impact every aspect of your life, from your job to your family. Make sure you understand what is at risk if you are convicted of these charges:

  • Driving While Ability Impaired by Alcohol (DWAI/Alcohol). BAC between .05 percent and .07 percent, $300 – $500 fine, up to 15 days in jail, license suspended for at least 90 days
  • Driving While Intoxicated (DWI). BAC of .08 percent or higher, $500 – $1,000 fine, up to one year in jail, license revoked for at least six months
  • Aggravated Driving While Intoxicated (Aggravated DWI). BAC .18 percent or higher, $1,000 – $2,500 fine, up to one year in jail, license revoked for at least one year
  • Driving While Ability Impaired by a Single Drug other than Alcohol or Combination Drugs and Alcohol (DWAI/Drug) (DWAI/Combination). $500 –$1,000 fine, up to one year in jail, license revoked for at least six months
  • Zero Tolerance Law violation. BAC .02 percent to .07 percent for a driver under age 21. $125 fine, no jail time, and license suspended for six months

With subsequent DUIs, the penalties become even more severe.  In fact, many second and third offenses  are considered a felony under New York DWI law and carry penalties up to 10 years in jail and permanent loss of your license.

Unless you are willing to simply accept these severe consequences, the single best thing you can do after a DUI arrest is to hire a qualified criminal defense attorney.

Benefits of using a New York DUI/DWI lawyer

Your instinct may be to quickly plead guilty and make the whole problem go away or to just handle your case yourself, but that plan carries risks. Not only do you face a fine, suspended license and possible jail time, but you also face having a DUI conviction on your permanent record, which is available for public review.  You also have one strike against you should you ever be arrested again for drunk driving.

An experienced attorney gives you the best chance of achieving acquittal. But even if you are convicted, an attorney can help minimize your sentence. At Gregg & Associates P.C., our DUI attorneys offer a strategy that helps you achieve a better outcome than you would on your own.
