Drunk driving penalties in New York

Being stopped for driving with alcohol or drugs in your system can result in serious consequences. Losing your license and going to jail can impact every aspect of your life, from your job to your family. Make sure you understand what is at risk if you are convicted of these charges:

  • Driving While Ability Impaired by Alcohol (DWAI/Alcohol). BAC between .05 percent and .07 percent, $300 – $500 fine, up to 15 days in jail, license suspended for at least 90 days
  • Driving While Intoxicated (DWI). BAC of .08 percent or higher, $500 – $1,000 fine, up to one year in jail, license revoked for at least six months
  • Aggravated Driving While Intoxicated (Aggravated DWI). BAC .18 percent or higher, $1,000 – $2,500 fine, up to one year in jail, license revoked for at least one year
  • Driving While Ability Impaired by a Single Drug other than Alcohol or Combination Drugs and Alcohol (DWAI/Drug) (DWAI/Combination). $500 –$1,000 fine, up to one year in jail, license revoked for at least six months
  • Zero Tolerance Law violation. BAC .02 percent to .07 percent for a driver under age 21. $125 fine, no jail time, and license suspended for six months

With subsequent DUIs, the penalties become even more severe.  In fact, many second and third offenses  are considered a felony under New York DWI law and carry penalties up to 10 years in jail and permanent loss of your license.
