Weapon and gun laws in New York

With increasing public demand for better enforcement on illegal gun use, police in New York are cracking down on gun crimes. An arrest for a gun law violation can have very serious, long-term consequences. If convicted of any of several gun-related crimes, you face mandatory minimum sentences, which are enhanced if you are convicted of possessing a gun during the commission of another crime. Additionally, a weapons charge could be bumped up if you have a prior criminal conviction.

  • First-degree criminal possession of a weapon. Possession of a bomb or 10 or more firearms. Class B felony. Sentence of five to 25 years in prison.
  • Second-degree criminal possession of a weapon. Possession of a loaded gun with intent to use against another person or outside a home without a permit. Class C felony. Sentence of 3.5 to 15 years in prison.
  • Third-degree criminal possession of a weapon. Possession with a prior conviction, firearm with a defaced serial number, or multiple firearms. Class D felony. Sentence up to seven years in prison.
  • Fourth-degree criminal possession of a weapon. Possession of any listed prohibited weapon. Class A misdemeanor. Sentence up to one year in jail.
  • Criminal possession of a firearm. Possession of a firearm, loaded or unloaded. Class E nonviolent felony. Sentence of probation up to four years in prison.
  • Criminal use of a firearm. Charged in conjunction with another serious felony. Sentence 3.5 to 15 years in prison.
